Did you know that a cup of coffee could spark a major lawsuit? Let me tell you about the famous Liebeck v. McDonald's case!” In 1992, Stella Liebeck, a 79-year old woman sued McDonalds after she was severely burned by its coffee. She sued McDonald’s for $20,000 after she was hospitalised for eight days for her third-degree burns. Experts testified that McDonald's served scalding hot coffee that can cause third-degree burns in seconds. In fact, knew its coffee was causing serious burns, but it decided that, with billions of cups served annually, this number of burns was not significant. Yikes!
Guess what? In the end, the jury decided to give Liebeck a whopping $160,000 in compensatory damages for her pain, suffering, and medical costs. The Liebeck v. McDonald's case had left several significant impact, such as the importance for manufacturers to provide clear warnings about potential dangers associated with their products, and prompted businesses to reevaluate their practices and consider customer safety as a priority.

Exciting news! I’m getting ready to go to Miami this summer for an amazing summer associate position I got at a big time law firm! My imposter syndrome is affecting me pretty heavily but I’m trying to put that aside so I can maintain my excitement for my new adventure.
While I was looking into some summer clothes to buy (because I have ZERO living in the North), I realized how boring lawyers fashion can be. I mean no offense to anyone who enjoys the classic buttoned-up lawyer style, but it’s just not for me. I abhor plainness and typical law fashion is just so plain. “Why can’t I just dress how I want!?” I thought. “There’s no reason why, as long as I remain professional, that I can’t put on some interesting belts, asymmetrical lines, interesting patterns and layers. Cause why not?! Why should I have to sacrifice creativity for the sake of looking “professional”? The answer is, I’m not! I have chosen to dress how I like and express my individuality exactly how I like. It’s hard enough studying law. I shouldn’t have to give up part of who I am too... So in 2023, I’m just not.
Stay tuned for some of my outfit inspiration!

Overcoming "Imposter Syndrome"
I am no stranger to "Imposter syndrome". It is something that has plagued my academic career since studying for GCSEs. It is something that already exemplifies perfectionism within me, all whilst adding a delightful feeling that no matter how hard you work it will never make you worthy of being in the setting you are in.
For those of you who do not know what "Imposter Syndrome" is, allow me to explain. "Imposter Syndrome" is a constant feeling that you do not deserve to be in the place you are, whether that is a workplace or at University. It can also apply to countless other settings.
Currently, I am attending a Russel Group University here in the UK that has one of the highest percentage of private school students in the country, It must also be mentioned that my law school is one that also contains a large proportion of international students who have attended either private international schools in the UK or top schools in their home countries.
Imposter Syndrome is a horrible feeling, but I have found some little ways to help me feel more confident in my classes and I want to share them with you.
Find a piece of clothing that makes you feel confident or important. For me, I find that a blazer or smart shirt does the trick. They don't have to be designer or expensive. Some of my favourite workwear items include items from supermarket brands and high street shops. (Remember, being comfy can be just as empowering so if you want to rock a hoodie and jeans... GO FOR IT!)
2. Music! Hyping yourself up with some energetic tunes is a great way to start your day. Taylor Swift is a personal favourite, but I also love musical soundtracks. Equally, something slower and more mellow like jazz or classical can make you feel like a movie character.
3. Share your feelings. Talking to family and friends about how you feel really can help. I recognise that not everyone has this, so looking online is also a great place. If you are at a Russel Group University, The 93% Club is also a a fab resource.
Remember, you are where you need to be and you absolutely deserve to be there. You would not have been given this opportunity if you did not deserve it.
I am already so proud of you!
Her Honourable Madame Justice xx

What Does 25 to life Mean?
Tumblr media
In legal terminology, a prisoner condemned to life imprisonment but entitled to parole after spending 25 years is said to be serving a “25 to life” sentence. It provides a means of establishing a certain minimum sentence without eliminating the possibility of parole release.
Although the sentence may formally call for 25 years of incarceration before granting parole, this may occasionally depend on the conditions of the prison population, a prisoner’s behavior, or other considerations. However, if parole is refused, the sentence can go on until the inmate dies.
The punishment may simply be stated as a “life sentence” in cases where the crime was especially atrocious, and parole is not an option.

Case Related to Art 1248
Consolidated Industrial Gases, Inc. vs. Alabang Medical Center
Ponente: Reyes, J.
Facts:
The case involves a dispute between Consolidated Industrial Gases, Inc. (CIGI) and Alabang Medical Center (AMC) over the installation of a medical gas pipeline system. CIGI entered into a contract with AMC to provide labor and materials for the installation of the system.
AMC failed to pay the remaining balance of the contract price, claiming that CIGI did not fulfill its obligations under the contract. CIGI filed a collection suit against AMC, seeking payment of the outstanding balance.
Issue:
Whether CIGI's demand for payment from AMC is proper.
Ruling:
The Court of Appeals (CA) reversed the Regional Trial Court's (RTC) decision, ruling that it was CIGI who breached the contract by failing to complete the project and turn over a fully functional system. The Supreme Court upheld the CA's ruling.
Ratio:
The Court found that CIGI had not fulfilled its obligations under the contract, as it failed to conduct the agreed test run and orientation/seminar.
CIGI's obligation was not limited to providing labor and materials, but also included performing a test run and conducting a seminar.
Therefore, CIGI's demand for payment was not proper. The Court rejected AMC's counterclaim for rescission of the contracts, as the breaches committed by CIGI were not substantial enough to warrant rescission.
The Court ordered CIGI to fulfill its obligations under the contracts, including conducting a test run and seminar, and turning over a fully functional system.

People vs. Webb, G.R. No. 176864, 14 December 2010.
A criminal trial is not about personal redress for the victims, but about determining the guilt and the just punishment of the accused.
The concept of “fair trial” is that the rights of the accused are protected, to the extent necessary to ensure fairness for him. Rights of the victims are not ignored, but they are respected only to the extent that they are consistent with the fairness of the trial for the accused.
